Former Bellator Champ Alexander Shlemenko Sues California Commission Over Drug Test

Former Bellator middleweight champion Alexander Shlemenko may have been suspended for three years and fined $10,000 by the California State Athletic Commission for failing his Bellator 133 drug test, but he’s not yet given up the fight.

Shlemenko (51-9) was handed the penalties at a June hearing, where he challenged the drug test results, which showed he had the steroid oxandrolone and its metabolites in his system, as well as a testosterone-to-epitestosterone (T/E) ratio of 50-to-1. The California T/E ratio limit is 4-to-1.

Last week, on Aug. 28, Shlemenko filed a lawsuit against the CSAC in Los Angeles County to try and get the suspension and fine overturned, according to legal documents acquired by MMAWeekly.com. The outcome of his bout with Melvin Manhoef, which he won via knockout, was changed to a no-contest as part of his punishment.

Shlemenko’s suit claims that the CSAC failed to give proper notice about his hearing, didn’t act consistently with how it handed out sanctions in previous cases, applied penalties that had not yet been officially adopted into the state’s rules, and disputed the commission’s assertion that his drug test sample was not required to be split into ‘A’ and ‘B’ samples. Shlemenko’s single sample was retested to verify the accuracy of the initial result, but was never split into two samples, as is common practice in most drug-testing situations.

The former champion was granted a trail setting conference on Dec. 2, according to a report by MMAFighting.com.
