Gwyneth Paltrow ski accident trial – live: Terry Sanderson ‘didn’t think’ crashing with Goop mogul was cool

Gwyneth Paltrow’s trial over a skiing accident entered its fifth day on Monday.

The incident took place on the slopes of Flagstaff Mountain, part of the luxury Deer Valley Resort near Park City, Utah, on 26 February 2016 when Ms Paltrow and retired optometrist Dr Terry Sanderson collided on a beginner’s course known as the Bandana Run. Ms Paltrow claimed it was Mr Sanderson who plowed into her.

Mr Sanderson, 76, alleges he was left with “permanent traumatic brain injury, four broken ribs, pain, suffering, loss of enjoyment of life, emotional distress and disfigurement”.

While on the stand on Monday, Mr Sanderson denied allegations by the defence that he’s suing Ms Paltrow to exploit her wealth and fame.

He said he wasn’t star-struck after learning that Ms Paltrow was the woman involved in the collision.

“I thought, ‘I’m not into celebrity worship,’” he told jurors on Monday.

Mr Sanderson filed for damages in January 2019 and is seeking $300,000 in compensation for the injuries he sustained, prompting the actress to file a countersuit in which she asks for a symbolic $1 should she win and for her legal expenses to be covered.

Mr Sanderson is arguing that Ms Paltrow is essentially guilty of the ski version of a hit and run. In his complaint filed in 2019, he alleges that after the collision, she “got up, turned and skied away, leaving Sanderson stunned, lying in the snow, seriously injured”.

“A Deer Valley ski instructor, who had been training Ms. Paltrow, but who did not see the crash, skied over, saw the injured Sanderson and skied off, falsely accusing Sanderson of having caused the crash,” the complaint states.

Ms Paltrow on the other hand, claims that her instructor did in fact witness the collision.

The rule of the hills in Utah is that those ahead of you have the right of way and that those coming from behind have to avoid others. Both Mr Sanderson and Ms Paltrow claim that they were lower down on the mountain.

Deer Valley adheres to the National Ski Areas Association responsibility code, which also says that all skiers must be in control and able to stop as well as avoid other skiers.

The man suing Gwyneth Paltrow over a 2016 collision at one of the most upscale ski resorts in North America is expected to take the stand on Monday as the closely watched trial goes into its second week in Utah.

Attorneys said Friday that retired optometrist Terry Sanderson, 76, would likely testify first on Monday, before his attorneys rest and hand the courtroom over to Paltrow’s defense team to make their case. Paltrow’s attorneys are expected to call her two children — Moses and Apple — and a ski instructor who was present the day of the collision.

Sanderson is suing Paltrow for more than $300,000, claiming she skied recklessly into him from behind, breaking four of his ribs and head trauma that post-accident manifested as post-concussion syndrome. Paltrow has countersued for $1 and attorney fees, alleging that Sanderson was at fault and veered into her from behind in a — first gradual and then sudden — crash.

While speaking to the press in 2019, Mr Sanderson said that he was transported down the slope on a toboggan by ski patrol because when he tried to ski down the rest of the way on his own, an acquaintance thought it appeared as if he no longer knew how to ski.

“I kept thinking, ‘I hope my head is still on straight and my neck is okay,’” Mr Sanderson said at the time, according to The Salt Lake Tribune.

“Luckily I had friends that were supportive and called and checked in on me and helped me, and stayed with me in some cases, because I sat in a chair and I couldn’t do anything. I couldn’t function. And so I’d get so tired I’d go to bed,” he added.

He said that he was still coming to terms with the effects of the collision and that some close to him had noticed his personality change.

Actor Gwyneth Paltrow’s day on the slopes in Park City, Utah was cut short seven years ago when she had to take some time to rest after she collided with another person coming down the hill.

She’s now taking part in a civil trial that began on Tuesday (21 March).

As she was climbing the hill on 26 February 2016, another skier slammed into her from behind. She suffered minor injuries, for which she says the man apologized immediately. She adds in her legal filing that she was “shaken and upset”.

According to her, Terry Sanderson, 76, a retired optometrist, said he couldn’t clearly remember what had happened after the “full body hit”. But to Ms Paltrow, the incident is as clear as day.

Rumoured GoPro video footage of Paltrow’s ski collision may not actually exist, the court heard on Friday.

Reference to footage of the 2016 incident had previously been made during the trial in an email sent by Mr Sanderson’s daughter.

The jury was previously shown an email, sent by Shae Sanderson-Herath, in which she referred to possible GoPro footage of the crash.

But giving evidence on Friday, Ms Sanderson-Herath said she had not actually seen any such footage, though she had believed it existed at the time.

“After my dad told me about what he was feeling and that he could hardly think, and that he had rung his bell, I believe he mentioned there had to be GoPro video,” she told the court.

“He said there has to be GoPro footage because there was this big blood-curdling scream, so that means someone with a GoPro would have turned to look and captured it.”

She added: “I have never seen GoPro video and I don’t know that it does exist. I believed there was GoPro video at the time and that’s why I said that. I just wanted my dad to have peace of mind that there was video out there that showed what happened.”

“I think that the ability to function at a high level was lost for Terry ... many of the things that gave him pleasure in life seem to have been abruptly diminished by this injury,” the doctor continued.

The radiologist said Mr Sanderson’s injuries, including broken ribs, would not have been “plausible” according to Ms Paltrow’s version of events, where the Goop mogul argues it was Mr Sanderson who rammed into her without warning.

The attorneys for Paltrow and Mr Sanderson, who is suing her, gave their opening statements in court on Tuesday.

The man skiing with the film star was Eric Christensen. At first, he and the Deer Valley Resort Company were named in the petition. They were later removed when a judge restricted the argument to be about the collision and to being between Ms Paltrow and Mr Sanderson, with the hit-and-run issue removed from the dispute.

The ruling led to the claim now being one of negligence against Ms Paltrow for allegedly causing the crash while what took place afterwards is out of bounds for the proceedings, KSL reported.

“No one with knowledge of Ms. Paltrow’s post-collision actions claims to have observed Paltrow acting recklessly,” the judge wrote in his order. “Even when interpreted in the light most favorable to [Sanderson], the undisputed facts fail to support his claim that Paltrow’s post-collision actions were likely to result in substantial harm, that they were highly unreasonable or an extreme departure from ordinary care, or that they came with an apparent and high degree of danger.”

While Mr Sanderson claims that Ms Paltrow and Deer Valley staff members skied away after the collision, Ms Paltrow alleges that Mr Sanderson told Mr Christensen that he was alright. Ms Paltrow says in her counterclaim that Mr Christensen alleged in a report that Mr Sanderson was responsible because he had “taken [Paltrow] out from behind”.

Mr Sanderson’s legal filing says that the report is false as the staff member didn’t witness the collision.

Paltrow appeared in court on Tuesday for opening statements in the case, wearing a high-necked cream jumper and brown trousers.

Lawrence Buhler, representing Mr Sanderson, told jurors that Paltrow’s behaviour on the mountain in 2016 had been “reckless”.

“Ladies and gentlemen… distracted skiers cause crashes. Defendant Gwyneth Paltrow knew that looking up the mountain and to the side while skiing down the mountain was dangerous,” he said.

“[She] was looking somewhere else blindly skiing down a mountain while looking up… [this] was reckless.”

Mr Buhler added that an injury being caused was “not a matter of if, but when” and that Paltrow “knew what she was doing was dangerous”.

He went on to tell the jury that the actor’s “neglect and conscious choices” had combined together to cause Mr Sanderson “four broken ribs and permanent brain damage”.

Gwyneth Paltrow reiterated multiple times that she had been the “victim” of a ski crash, as she began giving evidence in her US trial.

The Oscar-winning actress said she did “not believe” the testimony of previous witnesses and that her version of events was “categorically” the truth.

Ms Paltrow is being sued by retired optometrist Terry Sanderson over a collision at the Deer Valley resort in Utah in 2016.

She is accused of “slamming” into Mr Sanderson on a ski slope and falling on top of him, leaving him with several broken ribs and a severe concussion.

Ms Paltrow has denied the allegations, claiming that Mr Sanderson collided with her, and is counter-suing him.

The actress entered the witness box to give evidence wearing a dark blue skirt and a button-down blouse and began her evidence by describing herself as an “intermediate” skier who was “familiar” with the rules of skiing.

She denied that she had been engaging in “risky behaviour” on the day of the collision and reiterated multiple times that she had been skied into from behind by Mr Sanderson.

“I was confused at first and I didn’t know exactly what was happening,” she said, describing the incident.

“It’s a very strange thing to happen on a ski slope. I froze and I would say I got very upset a couple of seconds later.”

She added: “(I thought) Is this a practical joke? Is someone doing something perverted?… my mind was going very quickly and trying to ascertain what was happening.”

Gwyneth Paltrow’s lawyer apologised for being an “ass” to the daughter of the doctor suing the actress over a 2016 ski accident.

Attorney Stephen Owens made the admission after his cross-examination of Polly Sanderson Grasham, who had testified as a witness for her father, Terry Sanderson.

He claims Paltrow slammed into him in a “full body hit” leaving him with “permanent traumatic brain injury, four broken ribs, pain, suffering, loss of enjoyment of life, emotional distress and disfigurement”.

Mr Sanderson is seeking $300,000 in damages from the Oscar winner after alleging that her was left with permanent brain damage following the accident at the Deer Valley resort in Utah.

“If you had a choice between Mr Sanderson hitting Ms Paltrow or Ms Paltrow hitting Mr Sanderson, you would have to pick Ms Paltrow hitting Mr Sanderson from behind and falling on top of him to account for the rib fractures.”

“If you were to compare two scenarios… there’s only one scenario that would account for enough force application to fracture those ribs and that would be Ms Paltrow striking Mr Sanderson from behind and falling to the ground.

Mr Sanderson alleges that Ms Paltrow was coming down the beginner slope of Bandana Run on Flagstaff mountain in an “out-of-control” manner, according to Court TV.

He claims that she struck him so hard that he was knocked out. At a press conference in 2019, he said that moments before the collision, he “heard this just hysterical screaming like … King Kong in the jungle or something”.

He said at the time that he thought the speed at which Ms Paltrow was allegedly coming at him could explain the extent of his injuries. “A little bitty bullet can make a big hole,” he said, according to The Salt Lake Tribune.

At that press conference announcing the lawsuit, Mr Sanderson said he noticed a number of large “slow down” signs as he headed down Bandana run, so he slowed down but still stayed with the flow of other skiers coming down the slope.

“It was just instantaneous,” he said in 2019. “I got hit in my back. ... It felt like it had just drove me forward.”

He said he could remember not being able to control himself as he went down.

“And then that’s all I remember to that point — just out,” he said.

Gwyneth Paltrow told the court on Friday afternoon under cross-examination that she felt “very sorry for” Terry Sanderson.

“It seems he has had a very difficult life but I did not cause the accident so I cannot be at fault for anything that subsequently happened to him,” she told the jury.

The actor also testified that she did not give Sanderson brain injuries that her defence lawyer says showed up on a 2006 MRI.

The court was shown a selfie photograph of Ms Paltrow and her son Moses on the ski lift on the day of the accident and she testified that she always wears a helmet when she skis for safety and for some anonymity.

“When I am skiing I like to try to keep a low profile,” she added.

She was also asked about her history of skiing with her father, who died when he was in his 50s, causing her to step away from the sport for a while.

“I was pretty devastated by his death and being in a ski resort or on a chairlift was difficult for me and I avoided it for a few years until I had my own kids and I heard his voice in my head telling me I should teach them to ski,” she said.

She told the court that her first husband Chris Martin of Coldplay, did not ski but she had started again with now husband Brad Falchuk in an attempt to “blend” their two families.

She added that she was not distracted and was paying attention to where she was skiing on the day of the accident.
