Robert Kraft trial postponed indefinitely as prosecution appeals video ruling

The trial of New England Patriots owner Robert Kraft doesn’t seem like it will have a resolution anytime soon.

Nine days after Judge Leonard Hanser threw out video evidence of Kraft inside the Orchids of Asia Day Spa, the prosecution is appealing that ruling, arguing that the video is in fact admissible evidence and should be released. According to Reuters, the trial will be postponed indefinitely while the prosecutors make the appeal.

Judge Hanser originally ruled the evidence as inadmissible due to the presence of other people on the video. He called the evidence “seriously flawed” as it contained footage of people who were not under investigation receiving normal spa treatments from spa employees.

Kraft has pleaded not guilty, and his legal team has fought hard to prevent the public release of the video that shows Kraft inside the day spa. But Hanser throwing out the video evidence doesn’t mean it’s permanently blocked from public release. There are several circumstances under which the video could be released, including if the prosecution drops the charges against Kraft, or Kraft reaches a plea deal.

If the judge denies the prosecution’s appeal, it’s possible that the case against Kraft could be dismissed. Even if that happens, Kraft could still be punished by the NFL under its personal conduct policy.
